These general terms and conditions of sale (GTC) govern the sales of products of the 87C brand, distributed by the company Allande, 12 avenue Louis Ricoux, 87210 Le Dorat, registered with the Limoges Trade and Companies Register under number B 394 715 544, and any individual visiting or making a purchase via the website www.87c.fr. They are written in French and are subject to change at any time; the applicable GTC are those in effect at the time of the order.

Article 1 – Purpose

These general terms and conditions of sale define the conditions under which sales of 87C brand products, distributed by the company Allande (12 avenue Louis Ricoux, 87210 Le Dorat, RCS Limoges B 394 715 544), are made to individuals visiting or making a purchase via the website www.87c.fr. Users can consult the terms and conditions on the website; Allande reserves the right to modify them at any time. The applicable terms and conditions are those displayed on the website at the time the customer places an order.

Article 2 – Obligations for placing an order

Orders placed on the website www.87c.fr are reserved for individuals of legal age and with full legal capacity. The Buyer agrees to accurately provide all information necessary for the fulfillment of the service and guarantees its validity. Failure to do so will render the Buyer responsible for any consequences related to the information provided. All information collected remains strictly confidential.

In accordance with the French Data Protection Act of 6 January 1978 as amended and the GDPR of 25 May 2018, the Buyer has the right to access, modify, rectify and delete his personal data by contacting https://www.87c.fr/fr/ or by email at donneespersonnelles@87c.fr.

Article 3 – Product Information

3.1 Product Characteristics

The products offered for sale online are those presented on the Website. They are described and reproduced by Allande as accurately as possible. Product descriptions include essential characteristics (color, description, composition, care instructions) and the price including VAT. However, photographs cannot guarantee a perfect likeness, particularly regarding colors (screen quality, material rendering, technical adaptations, etc.). These differences do not constitute a lack of conformity and cannot lead to the cancellation of the sale. Allande cannot be held liable for any minor errors or omissions between the product's characteristics and its representation and/or description.

3.2 Product Availability

Products are offered for sale while stocks last. Only products listed on the Website at the time of the Customer's visit are offered for sale. When placing an order, the Customer is informed of the availability of the selected product. In the event of unavailability, Allande will inform the Customer as soon as possible by email. Customer service will offer to cancel the order in whole or in part, or to deliver only the available items. The Customer may be reimbursed for any sums unduly received for their order.

Article 4 – Price

Prices are shown in euros, inclusive of all taxes, but excluding delivery charges. Delivery charges are fixed and vary depending on the chosen method. Any additional charges will be indicated before the order is placed. Allande reserves the right to modify its prices at any time, particularly in the event of changes to tax regulations. The price charged is the price in effect at the time of the order. Products sold on www.87c.fr are exclusively for private individuals and may not be resold.

Article 5 – Order

All orders are placed on the website www.87c.fr in accordance with the displayed instructions. The Customer acknowledges having carefully read the Terms and Conditions before validation and accepts them without reservation.

  1. Select a product and a size, then click "Add to cart". You can modify your cart before ordering.
  2. Provide your contact details clearly and accurately.
  3. Choose the delivery method and price.
  4. Check your order and select your payment method on the secure Shopify Payments platform.

Article 6 – Order Confirmation

The Customer guarantees that they have the necessary authorizations to use the chosen payment method. After payment validation, an email confirms the order registration and summarizes the main details of the transaction.

Article 7 – Payment

The website www.87c.fr accepts the following payment methods: Carte Bleue, Visa, MasterCard, PayPal, and Apple Pay. Payment is processed immediately upon validation. Allande retains ownership of the merchandise until full payment is received.

Article 8 – Delivery

Delivery to mainland France and across Europe, excluding islands, to Germany, Belgium, Luxembourg, Netherlands, Austria, Spain, Italy, Portugal, Croatia, Estonia, Ireland, Latvia, Lithuania, Slovakia, and Slovenia, to the address provided during checkout. Average processing and delivery time: 7 business days after payment (estimated). In the event of an incorrect address, any additional costs will be borne by the buyer and no refund will be issued.

Delivery to mainland France Free delivery on orders over €120 (including VAT). For orders under €120 (including VAT):

  • Collection point (DPD Pickup): Delivery fee: €5.50 (including VAT). Collection point selection offered after payment.
  • Home delivery (DPD Predict): Delivery fee: €6.90 (including VAT).

Delivery to: Germany, Belgium, Luxembourg, Netherlands, Austria, Spain, Italy, Portugal Free delivery on orders over €150 (including VAT). For orders under €150 (including VAT): Delivery fee: €9.00 (including VAT)

Delivery to: Croatia, Estonia, Ireland, Latvia, Lithuania, Slovakia, Slovenia Free delivery on orders over €150 (including VAT). For orders under €150 (including VAT): Delivery fee: €15.00 (including VAT)

Article 9 – Product Conformity

9.1 Defective Products

All items are inspected before leaving the workshop. In case of a defect, Allande undertakes to replace the product with an identical one or to refund it according to the conditions below:

  • The buyer must check for any anomalies upon delivery. In the event of a damaged/stolen/broken package, they can refuse the goods and request that they be returned to the sender.
  • If the delivery is unconditional, the customer may return the product to Allande Customer Service (registered letter with acknowledgment of receipt): Allande, Customer Service 87C, 12 avenue Louis Ricoux, 87210 Le Dorat, within 6 months of receipt for apparent defects or non-conformity. The request must specify the defects observed.

Customer Service will notify you by email of its acceptance or refusal of the return. Acceptance is only final upon receipt and verification of the defect. If accepted, the return shipping costs and the cost of reshipping an identical product will be covered (reimbursement of return shipping costs upon presentation of proof of payment). Items must be returned in their original packaging, unworn, unwashed, and in perfect condition for resale. If the identical product is no longer available, Allande will offer a product of equivalent quality/price or a refund after inspection. Refunds will be issued within 14 days via the original payment method. Cash on delivery is not accepted.

9.2 Legal Guarantees

Legal guarantee of conformity (Consumer Code)

  • Art. L.211-4 : The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery (including those resulting from packaging, assembly instructions or installation where provided).
  • Art. L.211-5 : The property must be fit for the purpose usually expected of a similar property and, where applicable, correspond to the description, present the qualities announced and those legitimately expected; or present the characteristics defined by common agreement or the special use sought.
  • Art. L.211-7 : Defects of conformity which appear within 24 months (6 months for the occasion) from the date of delivery are presumed to have existed on the date of delivery (unless proven otherwise).
  • Article L.211-10 : If repair and replacement are impossible, the buyer may return the goods and receive a full refund, or keep the goods and receive a partial refund. The same applies if the agreed solution cannot be implemented within one month or causes significant inconvenience. No resolution is possible if the defect is minor.
  • Art. L.211-12 : The action resulting from the lack of conformity is time-barred after 2 years from the date of delivery.

Legal guarantee against hidden defects (Civil Code)

  • Art. 1641 : Warranty against hidden defects which render the goods unfit for use or which diminish their usefulness to such an extent that the buyer would not have purchased them or would have purchased them at a lower price.
  • Art. 1645 : If the seller knew of the defects, he is liable for all damages and interest in addition to the refund of the price.
  • Art. 1646 : If the seller was unaware of the defects, he must return the price and reimburse the costs incurred by the sale.
  • Art. 1648 para. 1 : Action within 2 years from the discovery of the defect.

Article 10 – Right of withdrawal

In accordance with Articles L.221-18 et seq. of the Consumer Code, the buyer has a right of withdrawal without giving any reason within 14 days from receipt of the order, by writing to sav@87c.fr or by registered letter with acknowledgment of receipt to: Allande, Customer Service 87C, 12 avenue Louis Ricoux, 87210 Le Dorat.

In the event of a return, the direct costs of returning the item are the responsibility of the customer. The item must be returned in its original packaging, unworn, unwashed, and in perfect condition. Refunds will be issued within 30 days of receipt and inspection. Exceptions (Art. L.221-28): returns are not accepted for unsealed goods that cannot be returned for hygiene/health protection reasons, including panties, briefs, thongs, shorty briefs, tangas, and, more generally, stockings from the collection.

Article 11 – Limitation of Liability

Allande cannot be held liable for non-performance of the contract in cases of force majeure, actions of the consumer, or unforeseeable and insurmountable third-party events. Allande disclaims all liability in the event of website interruption, bugs, fraudulent intrusion that has altered information, non-material errors relating to products, inability to contact customer service, and/or inability to access the website.

Allande cannot be held liable for any indirect damage (loss of operation, profit, revenue), even if foreseeable or brought to its attention.

Article 13 – Intellectual property

The website www.87c.fr and all its elements (texts, images, illustrations, logos, videos, products) are protected by intellectual property law worldwide and are the exclusive property of Allande. Any use or reproduction, in whole or in part, on any medium whatsoever, is strictly prohibited.

Article 14 – Protection of personal information

The information and data concerning you are necessary for order processing. By placing an order and accepting the Terms and Conditions, you authorize the use of your data for the exclusive use of the company Allande, in compliance with the French Data Protection Act and the GDPR.

Limited data collected: first and last name, telephone number, postal address, email address. This data is stored in our information system for the company's exclusive use. When the data is linked to an accounting/commercial document, it is retained in accordance with French legal accounting retention periods. Our infrastructure is secure and compliant with current standards.

GDPR rights: access, rectification, erasure, restriction of processing, objection, data portability. Article 16 – Mediation and Dispute Resolution

In the event of a dispute, the seller and the buyer will seek an amicable solution. Failing that, recourse may be made to conventional mediation (consumer mediation commission, sector-specific bodies) or any other alternative method (conciliation, etc.).

Article 17 – Jurisdiction Clause

This contract is governed by French law. In the event of a dispute and failing an amicable agreement, the consumer may bring the matter before one of the courts with territorial jurisdiction as defined by the Code of Civil Procedure, or the court of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.
